Default FCC loses again


As some may know, the FCC fined Pacetronics for selling a Galaxy 99, arguing that the radio was illegal to sell. Well, the FCC realized the errors of its ways after filing a lawsuit against Pacetronics to collect the fine. The FCC conceded it no longer claims Pacetronics did anything wrong and moved to dismiss the case against Pace. Apparently the FCC admitted in testimony that the classification of Amateur radios as legal or illegal is totally arbitrary and decided on a "case by case" basis. The Court ordered the case dismissed with prejudice, which means the FCC can never bring the case again.

It would have been much better if they actually took it to court and had their face rubbed in it by our judicial arm, rather than turning tail and walking away.

Sounds like harassment.
Neither could they have found this party guilty or liable for penalties to that excessive figure. I hope this isn't any indication of FCC ineptness. One would have to wonder - though...

I really don't think there needs to be anymore indication of FCC ineptness. FCC founded in 1934 and inept since.

Thing is the retards have been fighting the same LOSING battle for how long now, you'd think they would figure this out and change the rules of the 11 meter band, and possibly cause a little positive growth, and maybe even some possible revenues on import fees... Piss on the whiny old Stuffed shirts, thankfully most of them have one foot into it right now..

Granted, would still be "Outlaws" always has been/will be, they can wage "Jihad" on these "Outlaws" if they need it to stroke the shirts

Many possibilities, even some that could be beneficial to everyone...

im wondering what the ramifications of this are.

does this mean that the FCC cannot file this type of suit on anyone or just pacetronics?

does this mean that others who are fined for the same reason can use this as a precedent?

this seems like a big deal; i wonder what will come of it.

The fine is mostly irrelevant. While the clarification of the typo makes it a little less moronic, this is the FCC. Plain and simple solid proof of outdated government control, and a complete waste of tax payers hard earned income. This agency lost all touch with reality, and all scope of what it was created for long ago. Another hard smack in the face of "Of the people,by the people, for the people". We can all see what a wonderful job our government has done for us. The FCC will continue to kick at this dead horse, and will continue to waste our money doing it. I really do hope this will set a new standard in how these white shirts can conduct themselves. I really doubt it, but it would be a good thing. It is long past time to move toward new policies in the FCC.
