Leave it to california to ban mobile HF Radio?

This just posted today on QRZ. Leave it to Commi-fornia to regulate everything possible.

The words" specialized radio" is subject to interpretation.

I see a CB as NOT a specialized radio but an HF/VHF/UHF could be.

Keep a CB in your vehicle along with your mobile amateur radio and tell the Gestapo trooper pulling you over for illegal radio use that you were on the CB.

You always get your day in court.

Here is the section of interest found in part F of the ruling.

) For the purposes of this section, “electronic wireless communications device” includes, but is not limited to, a broadband personal communication device, a specialized mobile radio device,
 
wow.... i am scared to even use my radio in my car here in NY with the cell phone laws they put in...

Thing is, Ham radio is a FEDERALLY mandated, regulated subject. In which case, CA has no authority to alter it. In fact; they cannot.

Ever heard the expression
"Current events with no resistance have no potential".

No potential of what - one might ask? Well; that is the right question. It means that by creating a dilemma(s), they use it as a distraction so that they can slip a battleship through your back door. This method has become a means to realize a different end. Those forces that are against the Bill of Rights are still at work to take it away or alter it in CA. They want to see just how many are asleep at the wheel. Testing the waters. They believe that whatever fire they can start in CA can be carried through the country unopposed.

CA has some of the worst legislation ever proposed - historically.

Just about every piece of legislation that adds to the tax rate is tried, and more often than not, is accepted. They are being taxed to death in the name of better schools and new building projects.
Gov't Pork.
The tax rate where I live is both unbelievable and unacceptable to a rational mind.

Show them they are wrong.

Be vigilant..

You maybe right but like I said, their wording on specialized radio communication devices needs to be interpreted on what type of radios specifically.

You should know living out there california likes to think they only regulate themselves and aren't subject to Federal laws unless it serves them.

Coconino county in Northern Arizona did this same thing which included Ham and CB radio's but the local hams got together and were able to get the County to amend the ruling to exempt Ham and CB radios.

I recommend you guy's out there do the same thing although this will be tougher on a State level.
 
CA law making aside but related to the topic; the science is there proving the human brain can't focus on two things at once. Yes, we can multitask but our brain can't focus on two things at the exact same time. The brain switches focus quickly between tasks as we move from one to the other. So, even though we think we can drive and chat on the radio, talk on the cellphone or text and really believe we are focused on the road, it isn't happening.

I don't agree with every law on the books but when it comes to distracted driving there need to be strict laws in place. Cellphone use while driving is illegal here in MI but 75% of the drivers I see when I'm driving around are on the phone!! It's nuts and I was almost broadsided last Friday by a woman with a phone to her ear who ran a red-light. I was the first vehicle through the intersection, saw her coming from my right, hit the gas and my big American V8 shot me forward just fast enough for her to miss the rear of my truck by inches. She never even put the phone down and just slowly backed up from the middle of the intersection. I stopped at first and was pi$$ed but kept going instead doing something I'd regret.

Distracted driving is also the reason I'm selling my motorcycle. I've had to many close calls with cellphone zombies to keep riding a bike.

Yet cars built by all car mfrs have built-in cell phone options. So long as it is hands free operation, I have no problem with its use. Problem is, most people don't use that method. That should be mandatory in a car. That is, electronic cradling so that voice operation and hands free specs are pursued. That is not a frivolous proposition, for the very reasons you've stated above. Nationwide issue right there.

Yes radio regulations are federal regarding licencing and regulations however in the interest of safety state may be able to regulate usage when performing a task that is state regulated like driving. It's the same up here. It vet gray in that area. Remember those warnings in a blasting zone about not using radios? Legal or suggestive? What would be the legal standing if someone actually did cause a detenation? All good questons I suppose.

The ruling here is using it while in the act of driving a vehicle on the roadways.

I haven't had a chance to read the whole ruling but I would think the hands free exception comes into play.

And one thing leads to another, first it's conditional restrictions like this for now, then it could become a complete ban later on.

This is why we have to keep mobile radio bans from being enacted from the start and why I made this thread to call attention to this issue.

Wanna hear something shocking about CA local taxes?

My house is under the protection of Prop. 13, which freezes the property tax rate to pre-1973 property value. But the rebuilt house next door - as well as many other houses in the area that have done the same - pays around $22k each year. A chunk of that is set aside for local taxing. Seems the infinitely and galactically foolish voters of this area votes for every bit of revenue increase every time they scream for school improvements. They could have layered the walls of each school with solid gold by now. Yet, they keep falling for that same line of %$#@.

Point is, it seems that the politicians of CA are always looking to hoodwink the 'masses'.

They ought to be fired.
