No; the 99v is not illegal. It is illegal to use it on 11m but not on 10m. It comes from the factory as a 10m radio. Modifying it for 11m makes it illegal. The 949 is not the same radio, and it is quite legal. Apples and oranges...

Modifying it for 11 meter does not make it illegal. USING it on 11 meters is illegal.
 
stock, right out of the box, all 3 digit galaxies are legal for cb

the two digit ones are not legal for cb

just look on the back for an unmodified (aka: factory installed) fcc type acceptance sticker

I was under the impression that the Galaxy DX99 is not FCC type approved, so illegal to use.

Legal on 10 meters (Part 97 HAS NO type-acceptance rule, Hams can run any equipment they want, no FCC type acceptance is required.)

Illegal on 11 meters (Not only does Part 95 disallow non-certificated radios, but the 99v would violate several other Part 95 rules for it's higher than allowed power, and frequencies above and below the legal 40)

We're talking about USE here, not possession. Owning a 99v (even if you don't have a Ham lic.) is NOT illegal.

Ham MANUFACTURERS have to have their radios FCC certificated to market them in the US. Many people get confused by this. Once again, Part 97 has no restrictions as to what equipment a Ham can use, as long as they comply with all the other relevant rules. The Certification is a rule that applies to manufacturers, importers and companies that market the radios in the US.

If you a licensed amateur build it yourself then this rule applies but you can not sell multiple units without that acceptance.
 
it is illegal for what import, in this country? I see a sh*t load of em if they are illegal then we need to throw some damn whatchtamacallit at Ebay.

The law on the exports is kinda strange - they aren't illegal to import, but they are illegal to advertise for sale. So technically it's not illegal for a distributor to stock them and sell them to the dealers as long as they aren't advertising them for distribution to the general public.

Now they become illegal to sell when it gets to the dealer level and they start advertising them online.

As a consumer they aren't illegal to buy or own (ham license or not), but when you want to USE them you have to be a licensed ham and they only legally can be used on Ham frequencies.

As an individual owner they aren't illegal to sell or buy as long as you aren't selling multiple units with the intent to distribute.

The 949, as sold, is a CB radio and as far as I know Has be type accepted by the FCC.
This Warning is included in the owners manual:


FCC WARNING
All transmitter adjustments other than those provided on
front panel by the manufacturer must be made by or under
the supervision of the holder of an FCC – issued general
radio telephone operator’s license.


If it were sold as a 10 meter radio, that would not apply.
Galaxy has several CB radios for sale that are Type Accepted, 4 watts AM/12 watts pep SSB.
Mobile
DX 919
DX 929
DX 939
DX 949
DX 959
DX 979
and the Base model DX 2547
Out of the Box, they are legit CB radios and because they have type accepted, legal as Ice Cream.


The 99V is considered a export
The rule reads that it can not be imported FOR SALE as a CB radio
As a out of the box 10 Meter radio, a ham can have, use what ever
You can import one and use it where you are authorized by your license
I would not import and sell them as CB`s



If the FCC goes to a retailer, and walk in and the guy has A 10 meter radio sitting there already converted into a CB, the stuff is gonna hit the fan....
That is the point
NOT a CB out of the box
