How does one sell a radio such as a Connex 3400hp

When you have a radio such as this that is designed to be a 10 meter radio but works on a 11 meter. Can you sell it with the caveat that it's a 11 meter but you need a license such as a ham radio or is it pretty much a no sale? Technically it can be used to monitor cb but can't transmit? Yes or no?
