this may sound like a dumb question

It doesn't matter because a 4w dead key measures the same avg and pep.

the 4 watts that is fcc legal is that rms or pep?

Technically there is no such thing as RMS power,it's really average power, but the four watt restriction is for an unmodulated carrier. The pep limit is 12 watts for SSB which is weird because the 4 watt AM limit is actually 16 watts pep with 100% modulation.

i would imagine the human voice doesn't quite drive the amplifier as hard on AM as a sine wave test tone would,so the 16w PEP will probable rarely if ever be reached in everyday usage.
