With regards to the Class D allocation and spectrum surrounding it: The modern day FCC operates on a complaint driven basis. If you're a big enough ass-hat to incur multiple complaints, enforcement action will be taken. Especially if said complaints come from legitimate spectrum users or the general public.
I can also state from personal experience that the average mis-tuned Galaxy or Ranger is capable of far more spectral interference than one of the high-power 'Bowlers who is running a fundamentally clean station. In either case, though, if a complaint is lodged it's going to be actioned.
Jail isn't going to get the attention of violators. In rem seizure of the transmitters and related assets, on the other hand, WILL.
Bottom line: If you're you're going to operate rogue, be smart about it.
