legal use of R/C channels

At a former (closed) marine base near my home, the ground water is being pumped or treated.

At this site is in use a remote control RF link operating at 27.195MHz.

This device is transmitting a 4 watt FM data transmission pulsed about 1 second on and 1 second off. It is using the channel every day, nearly continuously.

After reviewing part 95.2xx rules, the only problem I can see is the near continuous use of the R/C channel. Somehow I think if such a device were operated in a city with lots of CB activity, it would get jammed into hell and back.

Anbody familiar with 95.2xx, is this "Long Range Wireless Switch System" rules compliant?
 

thats an rc channel and I think can use up to 25W with a certified radio, like my rc car that i run 24/7. it's not voice.
