Hey Now,

I have converted an Alinco DX-77 by removing jumper 'D' and it now TX and RX from 1.5 MHz to 30 Mhz ( including the 11 meter band (CB). If I open the case and switch hard-wired PC board switch from 100 watt to 50 watt and then implement the low power feature provided on the console of the rig; in essence keeping my RF out to 4~5 watts at most, using AM USB and LSB modes only - Is this prohibited re FCC Part 95 (operated on CB channel frequencies exclusively as opposed to sliding under and over designated CB channel frequencies.

No, it cannot be used on CB legally. All equipment for use on that band must be type accepted for that use. It is very simple. Doesn't matter who modifies the equipment, what the power output is and on and on, if it isn't type accepted, it isn't legal.

Hams may create whatever they want for use on the ham bands as long as it meets the minimum requirements for clean signal output and is within the power level output caps for the band they are working....though it can produce more, you just can't operate it that way. Hams cannot create their own equipment for use in other radio services.

It's probably cheaper just to get caught and pay the fine. It's only ten grandages, per offense per day, IIRC...

Thanks for the facts - I think I will stick to using the cobra 138 or 29 on 11 meters.

Although it is not TYPE accepted.

I Highly Doubt the FCC ever would ticket or fine someone for using a better performing radio then a Type accepted radio...So long as when used it is Not being used beyond 4 watts on Am and 12 watts PEP on SSB.

Bear in mind though...to the letter of the Law...any and all usage of 11 meters needs to be done by a Type Accepted radio.

But the FCC has way too many things they need to be doing to be bothered or worried about your using a superior radio, while using it properly on 11 meters.

They (FCC) are Not out to get people..

Case in point..
a few yrs ago...i got a letter from both the FCC and Newark airport
claiming i was responsible (newark airport said it was my fault..and FCC said they were going to check into it)for interfering with the control tower ..

Their control tower was 3.5 or 4 miles away (as the crow flies...I am in bayonne while newark airport is in newark on the other side of the river) .

So i expected rather quickly to hear a knock on my door and to have the FCC demand a inspection of my station and equipment.

instead 8 days later i got another letter ( from FCC this time) saying it was not my equipment that was the problem but that of newark airport.

So it is likely..that the FCC came to my location..listened to and recorded some of my conversations...then analized my power usage and cleanliness (or lack there of ) my signal.. while also taking note of my antennas and hardline feedline..

Then likely did the same to the control tower of newark airport.
But then found issues with the control tower equipment and not on my end.

My point being..
FCC is out looking for Abusers of the air waves and not people who take the time to transmit on legal frequency's with good clean signals (with legal power)

Yeah there's no specifics in their rule. Part 97 makes a generic statement about not saying things that are offensive to others but doesn't define offensive. There's no forbidden words list, nothing like that. The general intent is to not cause conflict on the air....common sense basically, and they tend to apply enforcement in that way.

Oh, don't forget the rule: "Citizens Band Radio operators shall at no time wear red underwear while transmitting at distances more than 50 miles."
