FCC at the tolls and scales

Try both of the above scenarios in court and see how they REALLY play out. In BOTH cases the radio was installed which implies intent. Yeah I know you can't PROVE intent but installing a radio and claiming you did not use it is pretty weak. Besides nobody installs a radio inless they intend to use it at some point in time and with human nature being what it is you can bet it was being used.

Rates right up there with shooting someone and ditching the magazine. No magazine on you so you could not have possibly been the shooter right?

I don't know how that got there officer. It must have been the one arm man.

well, lets see. 95.409 states that you must "Use" a certificated CB transmitter.

it does NOT say "use" to TX

it does NOT say "use" to RX

it DOES say "USE",................... PERIOD.

scanning/ listening IS "USING."

if it ain't certificated,......... it ain't legal on CB freqs,......... PERIOD

I really didn't get into the actual difference but just a few things are..We have to take physical examinations annually.. There are now extensive background checks..You are over the limit for alcohol at .04 and get this even if you are driving a VW you will be arrested if your alcohol level is .04 and above..Any accident minor or major no matter if it is their fault you have to have blood drawn to do a drug test. The only thing I have a problem with is if you are driving a car I don't think that it is fair to be arrested for a DUI at half the legal limit. I don't even drink but it seems unfair..

if you were to switch it to say, 10 meters, would you then be able to use that to listen with?
 
If breaking the law and getting introuble for doing so leads people to believe that it means we have no rights then THIS COUNTRY IS IN BIGGER TROUBLE THAN I THOUGHT!! L:eek:L!!

So Im wondering if you got nailed for drunk driving or for robbing a bank and you pulled the "I have no rights" card infront of the judge how much it would it help or what difference would it make?? LMA:LOL:!!!

You still don't get it. USE IS NOT THE ISSUE. INSTALLATION OF AN NON-APPROVED RADIO IS. If you have an amateur radio ticket it is LEGAL for you to use an export radio because hams do NOT need to have their radio gear certified. This is what allows them to use modified commercial or military gear as well as build their own gear. They may however ONLY use that export radio on approved amateur radio frequencies. The FCC says that you may only install a certified radio for use on the CB band. An export or "10 meter" radio is NOT certified. Period. No argument. If you install an export radio, I said INSTALL, use is irrelevant as the law pertains to installation, and you do not have an amateur radio ticket then you must be a CBer because an export radio typically covers CB and 10m amateur radio frequencies. This means that a CBer has installed a non-certified radio the act of doing so in and of itself is illegal. I cannot think of any easier way to explain it. There is no law being broken by impounding such a radio. There is no right being denied by impounding such a radio. The presence of a microphone or not has NOTHING to do with it. If the radio is INSTALLED then the law has been broken.

Spend an hour or two memorizing answers to questions like most people do nowadays and get a tech ticket and be 100% legal regardless of what the name on the radio is.

CBers and the dealers of export radios have been using a loophole for years to skirt the FCC. Now that loophole has become a noose and the FCC is drawing the ends tighter. Perhaps you are correct however that this is no way to treat the citizens of your country. A better idea would be to raid all the dealers and confiscate all the export radios and fine them about $1000 for each and every radio they have sold. That would indeed put an end to the problem pretty quickly I would think. I can't for the life of me understand why this has not happened yet. If they really wanted to clean house that would be the way to do it.
