Those radios must stand the FCC test and comply to standards - just like any other radio.
ANY radio will go bananas when the mod limiter is clipped.
They aren't illegal for a Ham operator to use them on 10 or 12m as designed; but if it modified for 11m - it is illegal.

NOT TRUE FOR 10 METER EXPORTS LIKE GALAXY, CONNEX, etc. Nearly any or all of those have yet or ever will receive FCC approval. This issue has been beat to death already.
The FCC has to approve every mass produced real HF radio for sale and to be used on amateur bands in the US.
Google search the new Icom 7610 and you will see this disclaimer just like every new HF radio before it had.
